Overview

Patrick Macharia has over 2 years post admission experience with key practice interests in constitutional and public law. He has represented clients across diverse sectors in prosecuting and defending proceedings on the constitutionality and administrative propriety of actions by county governments and government institutions. He has also participated in various constitutional petitions seeking interpretation of the Constitution of Kenya as well as enforcement of the Bill of Rights enshrined in Chapter Four of the Constitution of Kenya.

Experience

Participated in defending a constitutional petition challenging the constitutionality of the office of the deputy speaker in Nyeri County as the lead researcher.

Representing a group of individuals in enforcing their fundamental right to property as enshrined in Article 40 of the Constitution of Kenya relating to a eighty five (85) acres piece of land located within Nyeri Municipality.

Successfully defended the County Government of Nyeri in various judicial review proceedings filed by various bar owners challenging the action of the County Government of closing their respective bars and restaurants for non-compliance with the Nyeri County Alcoholics Drinks Control & Management Act, 2014.

Successfully defended the County Government of Laikipia in various judicial review proceedings filed by various bar owners challenging the action of the County Government of closing bars and/or suspending liquor licenses for non compliance with the Laikipia County Alcoholics Drinks Control & Management Act, 2014.

Defended the County Government of Nyeri in defending two constitutional petitions challenging the appointment of county executive members after the demise of the then Governor Nyeri in the year 2017.

Participated in a constitutional petition brought by residents of Nyeri on the budgetary making process at the county level as a key researcher.

Successfully represented three county executive members in a constitutional petition against the speaker of the county assembly of Nyeri and the director of public prosecution challenging the action of the speaker of the county assembly of ordering the arrest of the county executive members for failure to honour the county assembly summons.

Represented the County Government of Nyeri in defending a constitutional petition filed by owners of various private colleges within Nyeri County challenging the Nyeri County Finance Act of 2015 which had increased the annual levies on these institutions.
